Environmental permitting (pollution prevention and control)

Details of how to apply for a permit for activities that affect the environment and in particular emissions into the air.

Licence summary

If you carry out activities that can affect the environment, under Schedule 1 of the Environmental Permitting (England and Wales) Regulations 2010 (as amended) and in particular affect emissions into the air you must hold a permit for your installation or mobile plant. Some larger industries also have to control pollution to land and water as well. See How to apply.

Permits are obtained from your local authority. The Environment Agency regulate the larger processes.

Applications are made in writing, contain specific information about the activity and will be subject to a fee.

Businesses which require a permit have to hold one before commencing operations and have to comply with the conditions imposed on them.

Eligibility criteria

You will not be granted a permit if the local authority does not feel that you will ensure that the installation or plant will be operated in line with permit conditions.

Officers from the Environmental Protection Unit make regular inspections of permitted businesses and can require improvements to control measures where necessary.

Application evaluation process

The non refundable charges are from the 1st April 2011 to 31st March 2012. The charges related to permits are set by the Department for Food, the Environment and Rural Affairs (Defra) each year.

The local authority will take into account that all appropriate pollution prevention methods are taken, particularly through best available techniques and that no significant pollution is caused.

The local authority may be required to give notice of your application to any organisations as directed by guidance issued by Department of the Environment, Food and Rural Affairs (Defra), dependent upon the activity you will carry out.

If the local authority intend to attach an off-site condition to your permit they will provide notice to you, or the owner, lessee or occupier of the land if not you.

They must consider any representations made in relation to your application.

Will tacit consent apply?

No. The local authority is required to process your application within 120 days of the application being duly made. If the application is not determined within this timescale this can be taken as a deemed refusal.

Timescales for processing an application do not start until all the necessary information has been received in full.

Any applicant who is refused a licence can appeal to the local Magistrates' court. The appeal must be bought within 6 month's of receiving written notice of the authority's decision.
