Saved Policies

At South Somerset District Council we are in the process of producing a Local Development Framework that will eventually replace the Adopted Local Plan.

Regulations allowed for the Local Plan policies to be saved for an initial three years after adoption to allow time for the replacement Local Development Documents to emerge so the policies were saved until 26th April 2009.

As the replacement Local Development Documents have yet to emerge the District Council applied for direction under Paragraph 1(3) of Schedule 8 to the Planning and Compulsory Purchase Act 2004 to effectively extend the life of the policies within the Local Plan until the replacement Local Development Documents are adopted.

Not all of the policies in the Adopted Local Plan were appropriate to save, particularly those that have been superseded by developments in National Policy guidance, regional planning guidance and other guidance issued by the Government or policies that are now inconsistent with the guidance offered in these documents.

In South Somerset all but six of the policies in the Adopted Local Plan have been saved. The policies that have not been saved and should, after April 26th 2009, not be used to judge applications for development are:

Policy Description Justification for not saving
EU1 Renewable Energy Inconsistent with PPS22: Renewable Energy (2004)
EU2 Wind Turbines Inconsistent with PPS22: Renewable Energy (2004)
EU5 Flooding Superseded by PPS25: Development and Flood Risk (2006)
HG5 Replacement Dwellings in the Countryside  Inconsistent with class A of the GDPO (1st October 2008)
HG13 Sites for Travelling Show People Inconsistent with Government Circular 04/2007: Planning for Travelling Showpeople
HG14 Sites for Travelling Show People Inconsistent with Government Circular 04/2007: Planning for Travelling Showpeople

In the pages on the website where these policies have been quoted you will see that the text has now been crossed through to indicate that these policies are no longer relevant and should not be referred to.
