Full Variation of Club Premises Certificate

 

Licence summary

If you would like to add or change any of the following to your club premises certificate you will need to make a variation application.

Such applications can be by way of a full or minor variation, however the latter is subject to a number of restrictions.  Please contact the Licensing team if you are unsure which variation application to make.

Regulated Entertainment

Entertainment includes performance of plays, exhibition of films, indoor sporting events, boxing/ wrestling, live music, recorded music, performance of dance, and entertainment like music or dance.

There are a number of exemptions, detailed in the legislation together with the definition of regulated entertainment.

Supply of Alcohol

Authorisation under the Licensing Act 2003 is needed for any supply of alcohol. 

Days and Timings

For example you wish to extend your authorised hours for live music on Fridays from 22.00 hours until midnight or include another day in the operating schedule. 

Layout of Premises

This would include making structural alterations to the property.

 

Eligibility criteria

Only an authorised club member (or their agent) may apply to vary the club premises certificate.  This person is usually the club chairperson. A Licence may not be varied so as to vary substantially the premises to which it relates.

Application evaluation process

Applications must be sent to the licensing authority for the area where the premises are located.

Applications must be made on the appropriate prescribed form and be accompanied by any required fee.  List of current fees: Club Premises Certificate Fees.

Applicants are required to advertise their full variation application at the premises and in a local newspaper that circulates in the area in which the premises are situated. If the application is not made through the online process, applicants must also give a copy of the application form and plan (if appropriate) to the relevant responsible authorities, e.g. the chief police officer and the fire and rescue authority - see link below.  Please note applicants are required to serve two copies of the application and plans (if appropriate) on the Licensing Authority as one part of the Authority is the Responsible Authority and the other acts in an administrative role.

The licensing authority must grant the application, if no relevant representations are received. If however, they are made and not withdrawn a hearing must be held before members of the licensing committee, unless all parties required by the Act agree that such a hearing is unnecessary.

The licensing authority will serve a notice of its decision on the applicant, and any person who has made relevant representations.

Will tacit consent apply?

Yes. This means that you will be able to act as though your application is granted if you have not heard from the local authority by the end of the target completion period, which is subject to the submission of all information required and compliance with the advertising requirements. The timescale is 30 days after receipt of a valid application. 

If you are submitting this application by post tacit consent will only apply when the business can show proof of delivery from the Post Office or recognised courier.  You are also strongly advised to obtain proof of delivery of the copy sent to the Chief of Police.

Timescales for processing an application do not start until all the necessary information has been received in full.

Appeals
